CONGRESS DEBATES WHAT KIND OF LEGAL PROTECTION TO EXTEND TO TERROR SUSPECTS

09/27/06

WELCOME TO RADIOACTIVITY..... I'M ROB LOREI.... COMING UP TODAY WE'LL TALK ABOUT THAT AGREEMENT REACHED BETWEEN THE BUSH ADMINISTRATION AND THREE DISSIDENT REPUBLICAN SENATORS ON HOW TO INTERPRET THE GENEVA CONVENTION....

LAST WEEK THREE REPUBLICAN SENATORS REACHED AN AGREEMENT WITH PRESIDENT BUSH ON THE INTERPRETATION OF THE GENVA CONVENTION AS IT PERTAINS TO DETAINEES IN THE CURRENT WAR ON TERRORISM....THE COMPROMISE IS TO BE VOTED ON BY THE HOUSE AND SENATE THIS WEEK- BEFORE CONGRESS ADJOURNS FOR THE NOVEMBER ELECTIONS.

AMONG THE ISSUES--- WHAT KIND OF INTERROGATION METHODS- SUCH AS WATERBOARDING- ARE ALLOWED TO BE USED BY THE U.S. MILITARY, THE CIA AND PRIVATE INTERROGATORS....WHETHER CO-ERCED CONFESSIONS WOULD BE ALLOWED TO BE PRESENTED AT TRIAL, WHETHER PRISONERS WOULD BE ALLOWED TO SEE EVIDENCE USED AGAINST THEM, AND WHETHER UPPER LEVEL OFFICERS AND GOVERNMENT OFFICIALS WOULD BE HELD ACCOUNTABLE FOR TORTURE CONDUCTED BY THEIR SUBORDINATES....

THE GROUP HUMAN RIGHTS WATCH CAME OUT YESTERDAY AGAINST THE COMPROMISE. WE'RE JOINED NOW BY TOM MALINOWSKI, WHO IS THE WASHINGTON ADVOCACY DIRECTOR AT HUMAN RIGHTS WATCH.....

AMONG THE ISSUES RAISED WITH MALINOWSKI: DOES THIS COMPROMISE GUARANTEE THAT THE U.S. WILL ABIDE BY INTERNATIONAL LAW?

YOU SAY THE MOST DANGEROUS ASPECT: IT'S COURT STRIPPING POSITION...

YOUR GROUP SAYS: "INNOCENT PEOPLE COULD BE LOCKED UP FOREVER"

WE WERE ALSO JOINED BY:

CHARLES ROSE IS A PROFESSOR OF LAW AT STETSON UNIVERSITY COLLEGE OF LAW IN GULFPORT. I SPOKE WITH HIM EARLIER TODAY ABOUT THE LEGAL QUESTIONS SURROUNDING THE AGREEMENT BETWEEN PRESIDENT BUSH AND SENATORS MCCAIN, WARNER AND GRAHAM. ROSE TEACHES CRIMINAL LAW AND LEGAL ETHICS AT STETSON. HE IS ALSO A RETIRED MILITARY OFFICER. ROSE DISCUSSED TORTURE, THE GENEVA CONVENTIONS, THE MILITARY CODE, THE PROTECTIONS THESE BILLS MIGHT PROVIDE TO HIGHER UPS IN THE CHAIN OF COMMAND AND THE HISTORY OF HABEUS CORPUS.
