MARJORIE COHN, ( Professor at Thomas Jefferson School of Law and president-elect of the National Lawyers Guild, Cohn said: "Bush criticized the Supreme Court's recent decision in Hamdan v. Rumsfeld because it will put a crimp in the CIA's interrogation program. The Court declared that Common Article 3 of the Geneva Conventions protects all prisoners in U.S. custody. Our U.S. War Crimes Act defines violations of Common Article 3 as war crimes. Since the Bush administration has violated Common Article 3, officials could become defendants in war crimes prosecutions. Bush is trying to prevent this by asking Congress to water down our obligations under the Geneva Conventions." Cohn talked with WMNF's Rob Lorei about torture, waterboarding, deaths among detainees, responsibility in the chain of command, and Senator McCain's opposition to changes in Common Article 3.
